Welcome to BibiGPT! These Terms and Conditions of Use (hereinafter referred to as "Terms") govern your use of EvergreenAI's (hereinafter referred to as "Product") AI products and its services (hereinafter referred to as "Services") available at https://bibigpt.co.
By using the Services, you agree to abide by these terms. If you do not agree to these terms, do not use the Services.
1. Services
The Services include one-click summaries of video and audio content for beeping, YouTube, websites, podcasts, conferences, and local files. The services are intended for use in education, research, and digital note taking, among other uses. We comply with relevant copyright regulations and respect the rights of content creators.
2. Applicable Audience
The Services are available to individuals who are at least 13 years old. By accessing or using the Services, you warrant that you are 13 years of age or older.
3. Account Registration
To use certain features of the Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and password and are responsible for all activities that occur under your account. You agree to notify us immediately if you become aware of any unauthorized use of your account or password, or other security issues. You may not use another person's account or password at any time.
4. Content and Intellectual Property
4.1. Video, audio and other source content is copyrighted by their respective copyright owners and the Company has no ownership rights or interests in such content. The Services are provided by the Company to facilitate access to the Content and enhance the user experience without infringing any intellectual property rights.
4.2. The summaries, annotations and timestamps generated through the Services are the intellectual property of the Company. Users may use these summaries, annotations, and timestamps only for personal, educational, or research purposes, provided that they attribute the source to BibiGPT and link back to the original content. Other uses, including but not limited to reproduction, distribution or commercial use, require the prior written consent of the Company.
4.3. Privacy of User Uploaded Files: Audio and video files uploaded by you are considered your personal private data. We promise to provide strict privacy protection for these files. These files are used only for technical processing to generate summaries and related content; we do not claim ownership of these files, will not manually review the file content (unless required by law), and will not disclose or share them with third parties without your authorization.
5. User Conduct
In using the Services, you agree not to:
5.1. violate any applicable local, state, national or international laws and regulations;
5.2. violate the rights of any third party, including but not limited to intellectual property rights, privacy rights or contractual rights;
5.3. use the Services to reproduce, distribute or display any Content in a manner not authorized by these Terms, the Content owner or applicable copyright laws;
5.4. interfere with or disrupt the operation of the Services, or the servers or networks used to provide the Services; Use any robot, spider or other automated or manual process to monitor, copy or interfere with the Services or any Content made available through the Services.
5.5. Fair use & membership-tier limits. "Unlimited" or "unrestricted" membership tiers (including but not limited to Pro / Lifetime) are designed for single-person, normal personal use. You agree NOT to:
(a) Invoke the Services through automated scripts, batch jobs, crawlers, or other machine-driven workflows in volumes that far exceed reasonable individual use (e.g. processing hundreds of videos/audio files per day, sustained high-frequency requests);
(b) Resell, rent, share account credentials, API keys, or membership benefits to third parties, or use the account to provide commercial services to others in bulk;
(c) Exploit "unlimited" benefits for data harvesting, bulk content scraping, commercial resale, or any other activity that violates fair-use principles.
We reserve the right to monitor usage in real time, impose daily/monthly soft caps, suspend or terminate offending accounts, and seek recovery of actual service-cost losses caused by abuse. If you are unsure whether your use case is permitted, contact [email protected] before proceeding.
6. disclaimer of warranties and limitation of liability
6.1. the services are provided "as is" and "as available". the company disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
6.2. we do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. You assume all risks regarding the quality and performance of the Services.
6.3. in no event shall the company be liable for any direct, indirect, incidental, consequential, special, punitive or exemplary damages arising out of or in connection with the services or these terms, including, but not limited to, loss of profits, loss of goodwill, loss of use, loss of data or other intangible losses (even if the company has been advised of the possibility of such damages).
7. Indemnification
You agree to indemnify, defend and hold harmless the Company, its affiliates, officers, directors, employees, agents, licensors and suppliers from and against all claims, losses, expenses, damages and costs (including reasonable attorneys' fees) related to your violation of these Terms or any activity related to your account, including negligent or wrongful conduct.
8. Modification of Services and Terms
The Company reserves the right to modify or discontinue the Services or any part thereof at its sole discretion without notice. The Company may also revise these Terms at any time, and the revised Terms will be posted on the Site with effect. Continued use of the Services indicates your acceptance of and agreement to abide by the modified terms. It is your responsibility to review these Terms periodically to be aware of changes.
9. Termination
The Company reserves the right, in its sole discretion, to terminate your access to the Services, with or without notice, for reasons including, but not limited to, breach of these Terms.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is located, without regard to its conflict of law provisions. You agree to submit to the jurisdiction of the courts of the jurisdiction in which we are located for the resolution of any dispute arising out of or relating to these Terms or the Services.

The Company shall not be liable for any failure to perform its obligations under these Terms if such failure is due to any cause beyond the Company's reasonable control, including but not limited to natural disasters, war, acts of terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or raw materials.

You are responsible for compliance with all laws, regulations and other legal requirements that may apply to your use of the Services. The Company reserves the right to investigate and prosecute violations of these Terms in accordance with the law.

22. Survival
Upon termination of your access to the Services or termination of these Terms, any provisions of these Terms that by their nature should survive termination will survive termination, including, but not limited to, the sections regarding intellectual property rights, disclaimers, indemnification, limitations of liability, and governing law.
